Nike has been sued in a proposed class action in Portland, Oregon federal court. Consumers accuse the company of failing to refund tariff-related costs it passed on to consumers through higher prices. The suit follows the US Supreme Court striking down sweeping tariffs imposed by President Trump under the International Emergency Economic Powers Act. Nike paid approximately $1 billion in tariffs and allegedly raised footwear prices by $5 to $10 and apparel by $2 to $10 to offset those costs — and now stands to recover the same tariff payments twice. Nike, which expects tariffs to weigh on gross margin through August 2026, did not comment. Costco and EssilorLuxottica face similar lawsuits.
