Hermès’ Birkin sales tactics face renewed legal scrutiny

US consumers have updated their antitrust lawsuit against Hermès, alleging the luxury brand forces customers to spend significant amounts on other items before they can purchase a coveted Birkin bag. The three plaintiffs from California filed a revised complaint, adding new allegations after Hermès sought to have the case dismissed. The lawsuit claims that Hermès links Birkin bag purchases to a “sufficient purchase history,” violating US antitrust laws and engaging in false advertising and fraud. The plaintiffs argue that many customers are encouraged to buy additional products without ever receiving a Birkin bag. Hermès has denied wrongdoing, and the judge has expressed skepticism, suggesting that the company’s practices might actually foster competition by prompting consumers to explore rival brands. The case is ongoing in the Northern District of California.
